12 August 2026 Explained: What Actually Changed on Application Day

The regulation's application date repealed the 1994 directive, switched on the substances rules and the conformity machinery, and started producer registration. What it did not do is start the design grades.

The short answer

12 August 2026 is the day Regulation (EU) 2025/40 began to apply and Directive 94/62/EC was repealed. Four things switched on. The Article 5 substances regime: substances of concern to be minimised, PFAS in food-contact packaging held under the regulation's thresholds, and the 100 mg/kg heavy-metals ceiling. The general duty that packaging placed on the market be recyclable, ahead of the graded design criteria that operationalise it in 2030. The conformity machinery: packaging placed from this date needs its Annex VII technical documentation and EU declaration of conformity behind it. And producer registration under EPR in each member state of placement.

What did not switch on matters as much. The recyclability grades, recycled-content percentages, empty-space cap, format bans and reuse targets all carry later dates. A business compliant on application day is not compliant forever; it is compliant with the first wave.

The repeal and what it did to national law

The repeal of the 1994 directive ended the legal basis of the national packaging laws built under it, in the areas the regulation now occupies directly. National provisions that duplicated the directive's design and composition rules fell away; national systems the regulation leaves in place - registers, collection, enforcement, sanctions - continued, re-anchored to the regulation's own articles. Businesses that kept compliance files citing national transpositions of the directive found their citations pointing at a repealed instrument from this date.

The practical instruction is a citation sweep: every contract, specification and internal procedure that references Directive 94/62/EC or a national law made under it needs its reference re-based to the regulation article that now carries the rule. The rules mostly continued in substance; their addresses changed, and in a dispute the address is what gets argued.

The placing line through the warehouse

Application turns on placing on the market. Packaging placed before 12 August 2026 was placed under the directive-era law, and the new conformity machinery is not retroactive to it. Packaging first made available on or after that date - whenever it was manufactured - meets the new requirements. The line therefore runs through distribution, not production: slow-moving stock manufactured in 2025 but first supplied in September 2026 is new-regime packaging.

Evidence of placing dates is what makes the line defensible. Invoices, delivery notes and marketplace listing dates decide arguments; production dates alone do not. The foundations station covers the stock question in full; the calendar point is that the argument is won or lost on supply paperwork created at the time.

Registration from application

Producer registration is an application-date duty, not a 2030 one. From 12 August 2026, producers register in each member state where they place packaging, directly where established and through authorised representatives where they distance-sell into a state without one. Registers were at different readiness levels across the Union on the day - a factual, dated position the member-state station tracks - but uneven register readiness does not move the duty, only the mechanics of discharging it.

Auditing yourself against the first wave

A first-wave self-audit is four questions. Do we hold substance evidence for the packaging we place - supplier declarations against the PFAS thresholds and metals ceiling for food-contact and general lines respectively? Does a technical file exist, in the Annex VII shape, for packaging placed since August? Are we registered everywhere our routes make us producer? And have our templates and contracts stopped citing the repealed directive? Four yeses mean the first wave is closed and the work programme becomes the 2028-2030 wave, which is where the design money sits.

What application day did not change

Two continuities deserve recording, because first-wave commentary often missed both. Packaging waste systems did not stop and restart: collection, sorting and producer responsibility organisations continued under national arrangements, re-anchored to the regulation - no bin was collected differently on 13 August because of the date itself. And packaging lawfully placed before the date remained lawfully on the market; the application date is not a recall, a relabelling event or a shelf-clearance, and trade claims to the contrary - usually attached to a consultancy offer - should be read against Articles 70 and 71 and discounted.

The date's real character is a change of legal basis plus four switches, inside a running system. Businesses that treated it as either nothing or everything both misread it; the four switches in this guide's label check are the measure of it.
