PPWR Exemptions and Special Cases: What Sits Outside the General Run
The PPWR has no general small-business exemption and no sector-wide opt-outs. What it has is a set of specific adjustments - here they are, and how to claim one honestly.
The short answer
There is no general exemption from the PPWR - not for small businesses, not for any whole sector. What the regulation contains instead is a set of specific adjustments: certain obligations do not apply to certain packaging, some start dates run later for defined cases, and some requirements yield where another body of Union law governs the same risk. Each adjustment is written into the article that creates the obligation it modifies.
The honest method is unglamorous: take the obligation, read its article for its own exceptions, and record which provision you are relying on. An exemption claimed at that level survives an audit. An exemption assumed at the level of 'our sector is exempt' does not, because no such sentence exists in the text.
Adjustments that genuinely exist
Recycled content carries the clearest set: packaging parts under 5 percent of the unit weight are outside the calculation, and contact-sensitive packaging for medicines and medical devices receives specific treatment because recycled feedstock and patient safety pull in opposite directions. The reuse targets exclude defined movements - the 100 percent tier exempts pallet wrappings and straps by delegated decision, and cardboard transport packaging is treated separately in the target structure. Deposit return allows member-state exemptions for defined low-volume or take-back-equivalent cases. Design-for-recycling criteria are set per material category and can recognise formats that cannot meet a grade for functional reasons, through the delegated acts rather than through self-declaration.
Exemptions that do not exist
Small businesses ask about a turnover or tonnage threshold below which the regulation sleeps. For the design, substance, labelling and conformity duties there is none: a micro-producer's jar must meet the same heavy-metals ceiling as a multinational's. Relief for small operators, where it exists, lives in national EPR administration - simplified reporting or flat arrangements in some member states - and in support programmes, not in the regulation's core duties. Equally, 'our packaging is already recyclable' is not an exemption from grading, documentation or registration; it is a claim the file has to demonstrate.
How to record a special case
For each packaging line you believe is adjusted, write four things into the technical file: the obligation, the provision that modifies it, the facts of your case that meet the provision's conditions, and the date you checked it. That record converts an argument into evidence. Where the provision depends on a delegated act still to come - the design-for-recycling acts are due by January 2028 - record the dependence itself, so the file shows the position was provisional and why.
Adjustment is not always exemption: the deferred cases
A second family of special cases is easy to misread as exemption: obligations whose start runs later for defined situations. The design-for-recycling grades apply from the later of January 2030 or 24 months after their delegated acts - a deferral built into the obligation, available to everyone, that moves a date without removing a duty. Recycled-at-scale follows in 2035 on its own track. Several reuse and labelling provisions carry similar staged starts.
The file discipline is the same for deferrals as for exemptions: name the provision, note the date it produces on current facts, and diary the trigger that could change it - in this family, usually the publication of a delegated or implementing act. A deferral recorded that way is a plan. A deferral remembered vaguely as 'that starts later' becomes a missed date the first time an act is published early or a guidance note re-reads the clock.
The national layer: where small-scale relief actually lives
Because the product rules are now Union-level, the remaining national discretion concentrates in EPR administration, and that is where small-scale relief genuinely lives. Member states organise their registers and producer responsibility organisations; some run simplified or flat-rate arrangements for very small quantities, some set reporting thresholds, and support schemes for redesign sit at national and regional level. None of that touches the product duties, but it changes the cost and effort of the recurring paperwork considerably.
The member-state station tracks these arrangements as dated snapshots, because they change by national decision rather than by the regulation's calendar. If your volumes in a state are small, check its register arrangements before assuming the full reporting machinery applies to you in its heaviest form - and record the threshold you relied on, with its date.
