Registering in Every Member State You Sell: The Producer Register Process

One registration per market of placing, an authorised representative where you are not established, and the information the register demands. The process, state by state, without the gaps that stop shipments.

The short answer

The rule is geographic and unforgiving: a producer must be registered in the member state where the packaging is made available to end users - which for distance selling means the destination state, not the state of dispatch. A business established in one member state selling into twelve others holds thirteen positions to manage (its home register plus twelve), each with its own register, its own information requirements, its own reporting cycle and its own fee relationship, usually through a producer responsibility organisation. Where the producer is not established in the destination state, it acts through an authorised representative for EPR established there, who registers and answers in its name.

This guide works the process and the register of registers - the master list - that keeps a multi-state position coherent.

The information a registration carries

Registrations demand the producer's identity and legal particulars, the representative's identity where one acts, the packaging portfolio in the register's categories (materials and formats placed), the fulfilment route (which PRO, or individual fulfilment where permitted), and declarations that the information is true. The categories differ in detail between states - the harmonisation is of the skeleton, not yet of every form field - so the working artefact is a per-state data pack: the fields each register asks, the evidence each wants, the renewal and update rhythm each imposes. Updates are duties, not courtesies: portfolio changes, representative changes and PRO changes all re-open the registration, and stale registrations are a finding class of their own in EPR enforcement.

The authorised representative for EPR

The EPR representative is a distinct mandate from the conformity representative of the roles station, and conflating them is the standard structural error: the EPR representative registers, reports and pays in the destination state; the conformity representative holds declaration duties. One firm may hold both mandates, but the mandates are written separately, with separate scopes, fees and liability understandings. Choose representatives as financial counterparties, not as form-fillers: they will handle fee money, state correspondence and your registration's good standing. The representative register - state, firm, mandate scope, renewal date - belongs in the master list beside the registrations themselves.

The master list: one view of twenty-seven positions

The management artefact is a single register of positions: per member state, the registration number and status, the representative, the PRO, the reporting cycle and next deadline, the fee basis, and the last verification date. Maintained as data (the documentation station's register discipline applies verbatim), the master list generates the compliance calendar and the exception reports - states where registration lags a sales launch, representatives approaching mandate expiry, PRO contracts unsigned for a market already shipping. Sales expansion checklists should query the master list as a launch gate: a new destination state is a registration project first and a logistics project second.

The launch gate in practice

Make the gate mechanical. The sales system's new-market checklist carries a registration block: register queried (status, number), representative mandated (if applicable), PRO joined, reporting calendar created, fee basis loaded into pricing. Each block is signed by its owner with a date, and the first shipment's release requires the block complete. Businesses that run the gate discover their expansions slow by days; businesses that skip it discover - in the marketplace verification wave or a competitor's complaint - that they have been selling unregistered for a year, with the back-fees, penalties and delisting risk priced accordingly. Days are cheaper.

Registration debt and how it accrues

A closing warning on the failure mode this guide most exists to prevent: registration debt accrues silently and retroactively. The unregistered year is not forgiven when the registration is finally made; it is reported, back-fee'd and, in the serious systems, penalised - with the marketplace clock running throughout. Businesses discovering a gap should cure it as a project (register, reconstruct the placements, approach the scheme before the scheme approaches them), because voluntary cure is consistently cheaper than discovered cure in every EPR system that publishes its practice. The master list's exception view exists to make the discovery internal, early and boring.
